講題一:歐盟設計法規變革
EU Design Right Reforms – Once In A Generation Upgrade

在歐洲設計法規推出近25年後,歐盟正對該規範進行重大改革,包括對數位設計更便捷的註冊和執行、對3D列印之明確規範、適用於歐洲範圍內的維修條款,以及非歐盟設計者更得利用未註冊之歐盟設計之範圍等。講者將解析2024年初新法案之關鍵變化,對於有意於歐洲保護其產品視覺外觀的公司,將可獲得寶貴的新知。

Almost 25 years after they were first introduced, EU designs are getting a major overhaul, with greater ease of registration and enforcement of digital designs, clear provisions for 3D printing, a Europe-wide repair clause, and greater ability for non-EU designers to take advantage of unregistered EU design rights. This presentation will explain the key changes coming in early 2024, relevant for any company interested in protecting the visual appearance of its products.

主講人Michael Hawkins , Noerr Alicante IP, S.L.

Michael Hawkins is a partner in the German law firm Noerr’s Alicante (Spain) office, home of the European Union Intellectual Property Office. Michael specializes in EU trade mark and design law. He holds a degree in law from the University of Oxford and regularly speaks, publishes and teaches on trade mark and design-related issues, including in the EU trade marks and designs modules of the University of Alicante’s IP Master Program. Michael is heavily involved in the International Trademark Association (INTA), serving on its Board of Directors from 2019-2021. He is currently chair of INTA’s EU Designs Reform Task Force, and has been engaged with legislators and other relevant stakeholders in the reform of designs law in the EU for the past 6 years.

講題二:德國FRAND授權金訴訟案
The First German FRAND Rate Setting Action

本件訴訟為德國近期關於標準必要專利的重要案件,其中被告不僅以FRAND原則為抗辯,聲稱原告濫用市場支配地位,更積極於專利訴訟中請求法院命專利權人用特定FRAND條件授權原告。設定FRAND費率的訴訟過去只有英國法院支持,而此案為首次希望在德國達到相同結果。類似方式可能在新的歐洲單一專利法院(UPC)被主張。此新趨勢伴隨著最近提出的歐盟標準必要專利(SEPs)規範出現,該規範旨 在引入「總和授權金費率」概念作為FRAND討論的關鍵因素之一。Ralph Nack將解釋這些新趨勢如何被台灣企業在訴訟和談判中應用。

This is a recent significant case in Germany regarding standard-essential patents, where the defendant raised the FRAND principle not only as a defense, alleging the plaintiff’s abuse of market dominance, but rather proactively sued the patentee to grant a license on the patent-in-suit to specific FRAND conditions. Such so-called FRAND-rate setting actions were formerly only accepted by UK Courts, and this is now the first pending case in Germany aiming to achieve the same result. Similar approaches might be possible before the new Unified Patent Court (UPC). This new trend comes together with the recently proposed EU Regulation on Standard Essential Patents (SEPs), which aims to introduce inter alia the concept of an “aggregated royalty rate” as a key factor in FRAND discussions. Ralph Nack will explain how these recent trends can be used by Taiwan companies in litigation and negotiations.

Ralph is an expert on complex issues of patent law. He advises German and international clients primarily in patent litigation and in nullity and opposition proceedings. He is a leading international expert in patent licensing, especially regarding standard-essential patents (SEP FRAND licensing). His practice focuses on the areas of electronics, telecommunications, and chemistry. Ralph has about 20 years of experience in handling litigation in front of German courts; he is also admitted to practice before the UPC. He regularly represents TCL, Xiaomi, and Honor in various patent litigation matters in Germany.
